Turkish Citizenship Law Amendments 2023 through Ownership :

The Turkish government has made some amendments to the Turkish citizenship law in 2023 and these amendments included:

1- Previously, it was permissible to combine a contract of promise to sell and a title deed (Tapu). Now, it is prohibited to combine both and one of the options is required to obtain Turkish citizenship: either a contract of promise to sell or a title deed (Tapu).

2- Previously, it was permissible to have more than one contract and promise to sell at the same time, as multiple properties could be purchased from different projects with different contracts and promise to sell, but now it is not possible to purchase from multiple projects at the same time and it must be purchased from one project with one contract and promise to sell.

3- Previously, a foreigner who buys a property to obtain citizenship could resell it to a second foreigner who is not the mother’s national so that the latter could also obtain Turkish citizenship, but now any foreigner (even if he has Turkish citizenship) who owns a property is no longer allowed to resell it to another foreigner for the purpose of obtaining Turkish citizenship, even if the purchased property is registered

The property being sold does not necessarily have to have Turkish citizenship from its first owner. It is enough for the owner to be of foreign origin to prevent that buyer from obtaining Turkish citizenship by purchasing that property.

4- Previously, when buying a property to obtain citizenship, the title deed could be divided into several shares so that more than one person could obtain Turkish citizenship, but now it is no longer allowed to divide the title deed among more than one person.

5- The DAB BELGESI certificate issued by the Banking Department was delivered manually, but now the certificate will be delivered by KEP e-mail, a registered letter between the Banking Department and the Land Registry Departments.

Note: All of the above is specifically related to obtaining Turkish citizenship and does not prevent foreigners from selling their real estate. This means that a foreigner can sell his real estate to anyone, regardless of whether he is a foreigner or a Turk, but as explained, the right to benefit from Turkish citizenship law is limited by specific conditions and restrictions.
